Randomosity FITNESS FAQs

Q:  How much is shipping?

A:  Right now we are offering free shipping to anywhere within the continental US.  We will send your CDs through the mail as a first class package. 

Q:  What is a safe music volume level?

A:  The following information is based on the standards established by the Occupational Safety and Health Administration (OSHA) in the United States:

1. Music intensity during group exercise classes should measure no more than 90 decibels (dB).

2. Since the instructor's voice needs to be about 10 dB louder than the music in order to be heard, the instructor's voice should measure no more than 100 dB.

3. Fitness facilities are urged to place a class C sound level meter (available from many electronics stores for under $100) on a stand near the front or middle of the group exercise room to get a continuous measure of sound levels during classes. Instructors or other staff should regularly check the meter.

Q:  What’s the deal with other fitness music? Can I make a copy? Am I even allowed to use it for teaching my classes?

A:  No and No. Making a copy without permission violates the copyright owner’s exclusive right to reproduce the music, and using it in class without paying performance royalties violates their right to perform the music publicly. Public performance of music for commercial purposes is regulated under the United States Copyright and Trademark laws. These laws protect the rights of songwriters and music publishers in their original works.

Both songwriters and music publishers join performing-rights societies and transfer their rights to license public performances to these societies. These organizations serve as clearinghouses for the collection of royalties on their members' works. The three major performing-rights societies in the United States are the American Society of Composers, Authors and Publishers (ASCAP); Broadcast Music Inc. (BMI); and SESAC, Inc., formerly the Society of European Stage Authors and Composers.

Performance royalties for fitness facilities and classes are determined by ASCAP and BMI based on the following criteria:

  • The number of students per class per week

  • The size of the facility (square footage and number of floors) and whether the music is used in the background, for instructional use or both.

Depending on the facility size fees may range from $70 to $1,200 per year, and may be adjusted annually based on the amount of facility use reported. SESAC charges a flat fee of $140 annually for fitness facilities and does not require reporting. Most fitness facilities will already have blanket copyright licenses for performance use that is paid annually.

With Randomosity FITNESS Music you are authorized to use our music without paying performance fees only in fitness facilities and in teaching fitness classes and you may not videotape or audio tape the classes, you may not broadcast, cablecast, publicly distribute, or use the songs or make copies for any other purpose than the limited rights granted here unless you get written permission from Randomosity FITNESS.

Q:  What's the deal with the Subscription?

A:  For Fitness Professionals, Health Club and Fitness Facilities.  We appreciate your committment to buying our 12 regular releases so we give you a discount (you save $7 on each CD) and a free CD holder.  If you decide not to stick with the committment, you can cancel at any time. You are not obligated to buy any more CDs, but we will charge $2 per CD already received at the discounted price.

Q:  What about Licensing and Copyright?

A:  Our Licensing Policy:  When you purchase one of our CDs, Randomosity FITNESS Music grants you license to make one compact disc or cassette copy for your use only in teaching fitness classes. Without prior permission from Randomosity FITNESS, you may not reproduce, broadcast, publicly distribute, or use the music for any other purpose than the limited rights granted here.

Q:  Is it illegal to make my own copy of the CD?

A:  Yes it is illegal if you don't have permission. If you copy songs from different CDs or cassettes onto one tape, CD, or other media, you violate the copyright owner's exclusive right to reproduce the work.  Also if you use the music in class, over the speakers at a gym, or during your dance recital without paying performance licensing fees (royalties), you violate the copyright owner's right to perform the music publicly.

When you purchase one of our CDs, Randomosity FITNESS Music grants you license to make one compact disc or cassette copy for your use only in teaching fitness classes. Without prior permission from Randomosity FITNESS, you may not reproduce, broadcast, publicly distribute, or use the music for any other purpose than the limited rights granted here.

We recommend you make one copy of the title to use and carry around for teaching, and keep the master safe at home. When your copy becomes damaged and unusable, you are authorized to make one copy for your use only in teaching fitness classes. For further information your rights & limitations are found in sections 107 through 118 of the US copyright act (title 17, U.S. Code).

Q:  Can I copy it and to give it to a friend?

A:  NO. You are not authorized to do this and it would violate the exclusive right of Randomosity FITNESS Music to reproduce the work as the copyright owner.  It is common practice to copy tapes and swap with a colleague, but it’s wrong and it hurts the artists, producers, and company that make the music you like enough to share.

There is a better way. We recommend you temporarily trade your favorite Randomosity FITNESS Music with colleagues. After you review the songs, return to owner and buy your own copy of what you really liked. It’s fair, no bad karma, it’s legal, it’s a win-win for everyone, and at our low prices – it’s worth it.
